1.   The following terms apply to puppies sold as pets (up to the starred section but not including the starred section of this contract).  Breeding/show prospect puppies are sold under the same contract as pet puppies but also have the additional guarantee (starred section) with terms listed further along in this contract.  Puppies sold strictly under the pet section of this contract are not sold with the additional guarantee.

This puppy is guaranteed to be in good health at the time of this sale and has had all vaccinations and wormings that can have been done in regard to his/her age.  This information should be made available to the vet you have chosen.  It is imperative that you take your puppy to the vet within 72 hours after taking your puppy home.  We must be informed of any signs of illness and/or congenital defects within 4 days after the puppy leaves our premises if at the time of the first vet visit an illness or a congenital defect is discovered by the purchaser‘s vet.  This gives the purchaser an additional 24 hours after the puppy is seen by said veterinarian and is immediately following the initial first 72 hours.

J’aime Kennels reserves the right to  have a puppy returned to us immediately (within the 4 day period) if any illness is found at the time of the first vet visit so that we can be responsible for the care and cost of treating the puppy with our own vet.  We will NOT be responsible for any vet costs or medications etc. incurred by the purchaser at the time of the first vet visit and/or subsequent vet visits.  We must receive full documentation with a definitive diagnosis including cultures/smears and/or any other methods used by the purchaser’s vet to obtain the diagnosis within a 10 day period after the puppy leaves our facility and within 2 days after the purchaser‘s vet makes the diagnosis.   This period of 10 days commences the first day the puppy leaves our kennel.

We do not accept diagnosis of kennel cough, coccidia, giardia without a culture or stool sample having been done by the purchaser’s vet.  All reports of findings resulting from cultures or stool samples must be documented and received within a ten (10 day period) along with the name, address and phone number of the vet who saw the animal.  If this information is held from the seller then this contract is null and void.  See attached disclosure with information on giardia and coccidia.

If the purchaser opts not to return the puppy if illness has been diagnosed within the 4 day period then all further claims are null and void.

2.  We do NOT guarantee against conditions that may or may not be stress related but which have been documented by the medical field to be able to be triggered by stress from an inactive stage to an active stage from such stress related circumstances such as the move to a new home and/or the shipping process.  Many of these conditions are dormant in healthy dogs/puppies and become active cases during stressful periods.  Some of these conditions are coocidia, giardia, kennel cough and hypoglycemia.

3.  We are now using FENBENDAZOLE  (Panacur) as a wormer in each of our dogs/puppies sold… for 5 consecutive days before each sale as a means to not only worm for intestinal worms but to also eliminate the possibility that the puppy/dog has the protozoans called GIARDIA and COCCIDIA.  These are 2 of the most prevalent intestinal protozoans in the USA and the world.  See attached disclosure and information we have provided on these two protozoans.

4.  Hypoglycemia or LOW BLOOD SUGAR is a life threatening condition which can and does kill if not remedied when signs of lethargy become evident in a new puppy.  The use of NUTRI-CAL or another high calorie gel must be immediately introduced and we discuss this at length in our PUPPY CARE INFORMATION provided at the time of every sale.  Thus if a puppy dies due to this condition we are NOT responsible since every effort has been made to educate the purchaser on the signs and symptoms of this disorder.

5.  We guarantee against congenital defects for 2 (two) years from the date of sale.  In the event of a congenital defect occurring that will shorten the life of the puppy or if constant treatment will be required during the life of the animal we will then offer a replacement puppy after we receive complete documentation from a licensed vet on the condition of the animal and with a definitive diagnosis having been made.  We also require all documentation to be made available to J’aime Kennels as well as our veterinarian within a week of said diagnosis having been made.  The affected puppy must be returned to J’aime Kennels before any remedies are made.  Shipping costs are the responsibility of the purchaser.

J’aime Kennels does not give money refunds…..replacement only…..same breed and sex…..contingent on availability…. except in the case of paragraph 1, where all stipulations have been met pertaining to Maine law.

6.  If puppy purchaser desires to keep a puppy with a diagnosed congenital defect and the puppy requires a surgery to correct the problem and the surgery exceeds the cost of the puppy we will then offer a replacement puppy free of charge to the puppy purchaser after the surgery has been performed and we have received all documentation concerning the surgery.

J’aime Kennels reserves the right to have our vet confirm that a surgery is needed in order for a puppy to have a happy healthy normal life and also that the surgery has indeed been performed before any replacement puppy will be made available to the purchaser.

7.  In the event of a fatality J’aime Kennels reserves the right to have a necropsy done by a vet or university of our choice before any replacement is offered to the purchaser.  After reviewing all findings a decision will be made by J’aime Kennels as to whether or not a replacement puppy is to be offered to the purchaser.  A definitive cause of death must be discovered in order for a replacement to be given.  J’aime Kennels has a right of recovery against purchaser if death has been caused by anything other than a life threatening congenital defect.

8.  Registration paper on puppies sold as pets will be checked as LIMITED REGISTRATION in the case of an AKC registered dog.  Dogs registered with other registries other than AKC will have their registration paper retained by seller.

All AKC registration papers will be made available either at the time of sale or forwarded by mail to the purchaser.

9.  Any legal issues or court proceedings concerning the puppy purchased under this contract will be resolved in the State of Maine which is where the sale has been conducted.  This extends to internet sales across state lines as well.

10.  If at any time in the life of the puppy/dog concerned in this contract the purchaser becomes aware of any abuse and or neglect of the same we reserve the right to retrieve the animal and find him/her a more suitable home.

11.  If at any time in the life of the puppy/dog concerned in this contract the purchaser due to unforeseen circumstances cannot continue to keep the dog we are always willing to accept the dog back and find a more suitable home for him/her.   No money exchange or replacement is offered to the purchaser in this situation.
12.  All puppies/dogs must receive a full health exam and a health certificate in order to be shipped by air or ground transport across state lines.  We consider this health certificate as proof that the puppy is free of communicable disease and/or sickness at time of sale.

This additional guarantee covers puppies/dogs sold as SHOW and/or BREEDING PROSPECTS.  Prospect in this contract does not mean that the puppy/dog will NOT develop a show disqualifying fault.  Prospect means that at the time of the sale of this puppy/dog, he/she, does not have a show disqualifying fault that has been discovered or as of the time of this sale has not yet become evident.  Puppies go through many changes during their growing and maturing and something as simple as a bite going off (meaning incorrect bite according to breed standard) can turn a show/breeding prospect into a PET quality animal.

This guarantee is to assure the purchaser that any dog sold under this guarantee will be replaced with another puppy/dog of show/breeding quality if a show disqualifying fault becomes evident in the dog described on the front page of this document.  Complete documentation must be provided along with pictures of the dog showing close-ups of the fault if the purchaser is not located close enough to J’aime Kennels so that we can view the fault in person.  A licensed veterinarian must also examine the dog and his/her documentation must be made available to J’aime Kennels.

A determination as to whether or not a show disqualifying fault exists after a claim having been made is at the discretion of J’aime Kennels.  A third party will be consulted if there is a disagreement concerning the fault.  This third party will be either a breeder well versed in the breed and/or a veterinarian familiar with the breed.

Replacement is CONTINGENT on availability…..same breed, same sex, unless agreed upon by both parties.
